These General Terms of Service (the “Terms”) constitute a legal and binding agreement between Maillead.io (referred to as “Maillead.io”, “We”, “Us”, “Our”, or “Service Provider”) and you, or if you are representing an employer or client, then that employer or client (“You” or “Client”), which governs your use of Maillead.io’s website (https://maillead.io), the emailing services, and all other related services provided by Maillead.io (collectively, the “Services”).
Maillead.io reserves the right to modify or update these Terms at any time and at its sole discretion, either by posting the changes on its Website or by providing some other form of notice. We will strive to provide at least 14 days’ notice before these changes take effect. Your continued use of the Services will be subject to the most current version of the Terms posted on our Website at the time.

Article 1: Definitions
Each capitalized term shall have the meaning defined here, unless stated otherwise.
- Assistance Services: Any consulting, development, configuration, and settings assistance provided by Maillead.io to facilitate your access to and use of the Service.
- Data: Any electronic data, whether personal or otherwise, collected, managed, processed, and/or shared by the Client and Service Provider through the use of the Services.
- Service: The Maillead.io external application solution hosted on servers and/or cloud infrastructure designated by Maillead.io, which you may access and use remotely.
- Intellectual Property Rights: All industrial property rights, including patents, trademarks, designs and models, copyrights, and related documentation.
- Operating Policies: The operational rules, guidelines, and processes Maillead.io follows in operating the Service, compliance with which may also be required of the Client.
- Specific Terms: Specific terms and conditions mutually agreed upon with the Client, detailing the financial and technical elements as specified in a quotation.
- Website: The web pages associated with the technological features of the Service as described in the Service Documentation.
Article 2: Support and Service Levels
2.1 Reasonable Efforts
We commit to using reasonable efforts, consistent with prevailing industry standards, to ensure that emails sent by you are properly delivered to recipients’ electronic mailboxes. We provide an online automatic monitoring service, enabling real-time updates and modifications to your mailing lists and email campaigns.
2.2 Support and Service Levels
You are responsible for designating an administrator (“Administrator”), who will collect information and assistance requests from your users and attempt to address them. We provide second-level support (“Support”), which includes resolving issues that the Administrator has been unable to rectify despite their best efforts. The Administrator may initiate support requests by sending a detailed ticket to: contact@maillead.io.
Article 3: Use of the Services
3.1 Usage Guidelines
You must adhere to the terms and restrictions specified in these Terms and in the Operating Policies. You are responsible for ensuring that all users associated with your account comply with these guidelines. You are subscribing to the Services on your own behalf and must not use the Services for third-party purposes or resell them.
3.2 Account Security
You must provide accurate information for order processing, including a valid email address. You are responsible for maintaining the confidentiality of your credentials and must immediately inform us of any unauthorized use of your account.
3.3 Content Responsibility
You bear sole responsibility for any content transmitted via the Services. The content must comply with applicable regulations and must not violate any intellectual property rights or contain malicious software.
3.4 Sending Policy
You must adhere to our Sending Policy. Any breach, particularly sending unsolicited emails, may result in termination of your account or restrictions on your sending capabilities. No refunds will be issued in the event of termination.
3.5 Fair Usage Policy
We implement a Fair Use Policy to prevent abuse. Accounts using custom configurations outside of major providers (e.g., Google, Yahoo) must adhere to reasonable limits. Violating these limits may result in restrictions or removal from email services.
Article 4: Compliance with the Law
You must comply with all applicable laws and regulations in the country from which you access the Website and/or use the Service. You agree to indemnify and hold Maillead.io harmless from any legal actions or losses due to your non-compliance.
Article 5: Subscription Plans
5.1 Plan Term
Subscription plans are either monthly or yearly. Your subscription will automatically renew unless canceled.
5.2 Plan Changes
You may upgrade or downgrade your subscription plan at any time. The new plan charges will apply immediately for upgrades, and the downgrade charges will apply after the current term ends.
5.3 VAT and Taxes
Prices on the pricing page do not include VAT or other taxes. Appropriate taxes will be applied based on your country or region.
5.4 Fee Changes
Maillead.io reserves the right to change fees with a 30-day notice period.
Article 6: Termination
6.1 Termination by Maillead.io
Maillead.io may terminate your account for reasons including non-payment, breach of laws, or misuse of the Services. No refunds will be provided.
6.2 Consequences of Termination
Upon termination, all outstanding amounts become due immediately. You will no longer have access to your account or data except as required by law.
Article 7: Intellectual Property
7.1 Trademarks
Maillead.io and all related trademarks are registered trademarks owned by Maillead.io. You are prohibited from using them without express written consent.
7.2 Copyrights
All content on the Website is protected by copyright laws. Unauthorized use or reproduction is prohibited.
Article 8: Warranties and Limitations of Liability
8.1 Warranties
Maillead.io strives to deliver a functional Service but does not guarantee the absence of errors or bugs.
8.2 Limitation of Liability
Maillead.io is not liable for indirect damages or losses, including loss of data or profits. Liability is limited to the amount paid by you for the Service in the last 12 months.
Article 9: Confidentiality
Both parties agree to maintain the confidentiality of all information exchanged during the execution of this Agreement.
Article 10: Miscellaneous
10.1 Agreement Transfer
You may not transfer this Agreement to any third party without prior written consent from Maillead.io.
10.2 Entire Agreement
These Terms, along with any associated documents, represent the complete agreement between the parties and supersede any prior agreements.
10.3 Force Majeure
Maillead.io will not be held liable for delays due to events beyond its control (e.g., natural disasters, cyber-attacks).
Article 11: Your Data
11.1 Ownership of Your Data
You retain full ownership of your data. Maillead.io only requires the right to access and use it to provide the Service.
11.2 Data Use
Maillead.io may use third-party services (e.g., AWS) for service delivery and backups. You are responsible for ensuring that your data complies with these Terms.
